{"id":1048,"date":"2019-02-04T05:29:36","date_gmt":"2019-02-04T05:29:36","guid":{"rendered":"https:\/\/codir.net\/?p=1048"},"modified":"2019-02-04T05:29:36","modified_gmt":"2019-02-04T05:29:36","slug":"labor-activist-ali-nejati-denied-medical-treatment-against-doctors-orders","status":"publish","type":"post","link":"https:\/\/codir.net\/?p=1048","title":{"rendered":"Labor Activist Ali Nejati Denied Medical Treatment Against Doctor\u2019s Orders"},"content":{"rendered":"<p><em><strong>Petition Signed by 800 People Calls on Iran to Release Striking Haft Tappeh Workers<\/strong><\/em><\/p>\n<p>Detained labor rights activist Ali Nejati is being denied medical treatment for heart disease and kidney and prostate problems in Shush Prison in the city of Andimeshk, Khuzestan Province, against the prison clinic doctor\u2019s orders, according to a\u00a0<a href=\"https:\/\/t.me\/syndica_7tape\/1660\">report<\/a>\u00a0posted on the Telegram app channel of the Haft Tappeh sugar mill worker\u2019s union on January 27, 2019.<\/p>\n<p>Nejati, who was imprisoned for engaging in peaceful activism, had refused to go to the hospital in hand and foot chains, which are only required for prisoners deemed extremely violent.<\/p>\n<p>During phone contact with his family members, he frequently coughed and complained of pain in his chest and eyes, the union said in its report, adding:<\/p>\n<p>\u201cThe state prosecutor in Andimeshk is throwing roadblocks at this Haft Tappeh union member\u2019s access to medical care. Ali Nejati\u2019s doctor has confirmed that it would be dangerous to keep him in a closed environment. Prison conditions will make his illness worse. According to the law, he should have been sent to the medical examiner\u2019s office. Nejati has said that he would not go to any medical center in handcuffs and ankle chains and so his family have asked the authorities to grant him furlough for a few days so he could take care of his medical issues.\u201d<\/p>\n<p>Independent\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2015\/04\/international-workers-day\/\">unions<\/a>\u00a0are not allowed to operate in Iran, strikers often lose their jobs and risk arrest, and labor leaders who attempt to organize workers and bargain collectively are prosecuted under national security charges and sentenced to long prison sentences.<\/p>\n<p><a href=\"http:\/\/www.iranhumanrights.org\/2011\/06\/saeed-pourheidar-1\/\">Political prisoners in Iran<\/a>, including\u00a0elderly inmates, are singled out for\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2017\/01\/keyvan-karimi-filmmaker-hospitalization\/\">harsh treatment<\/a>, which often includes\u00a0<a href=\"about:blank\">denial of medical care<\/a>. The threat of\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2012\/10\/sotoudeh-hr-or\">withheld medical care<\/a>\u00a0has also been used as an\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2016\/11\/maryam-akbari-monfared-2\/\">intimidation tool<\/a>\u00a0against prisoners who have challenged the authorities or filed complaints.<\/p>\n<p>The report also noted that Nejati is able to post bail set at 200 million tomans ($47,500 USD) to go on medical furlough but the court refused to accept his pay stub as proof of payment.<\/p>\n<p><a href=\"http:\/\/www.iranhumanrights.org\/2016\/06\/wwr-furlough\/\">Furlough<\/a>, temporary leave typically granted to prisoners in Iran for a variety of familial, holiday, and medical reasons, is routinely denied to political prisoners as a form of additional punishment.<\/p>\n<p>According to Article 235 of the\u00a0<a href=\"http:\/\/prisons.ir\/%D9%82%D9%88%D8%A7%D9%86%DB%8C%D9%86-%D9%88-%D8%A2%DB%8C%DB%8C%D9%86-%D9%86%D8%A7%D9%85%D9%87-%D9%87%D8%A7\/%D8%A2%DB%8C%DB%8C%D9%86-%D9%86%D8%A7%D9%85%D9%87-%D8%B3%D8%A7%D8%B2%D9%85%D8%A7%D9%86-%D8%B2%D9%86%D8%AF%D8%A7%D9%86-%D9%87%D8%A7\/\">State Prisons Organization\u2019s Regulations<\/a>,\u00a0transferring prisoners to medical facilities in chains \u201cis not permitted unless in necessary cases determined by the head of the prison.\u201d<\/p>\n<p>Article 170 requires prisoners to be chained \u201cif there is a threat to others, potential damage to public property or possibility of escape.\u201d<\/p>\n<p>Prison authorities have provided no evidence that the prisoner of conscience is violent or a threat to anyone.<\/p>\n<p>Intelligence Ministry agents\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2018\/12\/detained-protester-reportedly-tortured-as-iranian-sugar-mill-workers-demand-unpaid-wages\/\">arrested<\/a>\u00a0Nejati on November 29, 2018, accusing him of participating in the\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2018\/12\/haft-tappeh-labor-activists-beaten-at-khuzestan-intelligence-ministry-center-say-relatives\/\">ongoing mass protests<\/a>\u00a0by unpaid Haft Tappeh workers in the city of Shush, near Andimeshk.<\/p>\n<p>Since being detention, the labor activist has also been denied legal counsel.<\/p>\n<p>On January 19, his\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2019\/01\/iran-release-labor-activists-re-arrested-for-revealing-theyd-been-tortured\/\">forced confession<\/a>\u00a0was aired by the state-run Islamic Republic of Iran Broadcasting (IRIB) organization on national TV along with those of other labor activists including\u00a0<a href=\"https:\/\/iranhumanrights.org\/2019\/01\/iran-release-labor-activists-re-arrested-for-revealing-theyd-been-tortured\/\">Esmail Bakhshi<\/a>\u00a0and\u00a0<a href=\"https:\/\/iranhumanrights.org\/2019\/01\/sham-investigation-of-labor-activists-alleged-torture-lacks-impartiality-ignores-witnesses\/\">Sepideh Qoliyan<\/a>.<\/p>\n<p>IRIB has a long history of broadcasting\u00a0<a href=\"http:\/\/www.iranhumanrights.org\/2014\/07\/irib-hrs-violations\/\">forced confessions<\/a>. Typically well-staged productions, they are used to defame dissidents, intellectuals, and other individuals whom the authorities wish to discredit by legitimizing their prosecution and amassing public support for their sentences.<\/p>\n<p>In the video edited by agents of the Intelligence Ministry, Nejati admitted to being part of a four-member information channel on Telegram\u2014which is not illegal in Iran.<\/p>\n<p>Nejati\u2019s case has not received as much attention as Bakhshi\u2019s, which made international headlines after he wrote on Instagram that he had been tortured while held for 25 days in detention facility under the control of the Intelligence Ministry.<\/p>\n<p>Bakhshi\u2019s revelations, which caused public outcry in Iran and led to several former political prisoners stating that they had also been tortured while in Iranian state custody, was corroborated by witnesses including Qoliyan, a freelance journalist who had been arrested along with Bakhshi.<\/p>\n<p>Bakhshi was re-arrested on January 20 along with Qoliyan.
